    GAMBIA: High Court Orders EFSTH to Produce Medical Report for Abdoulie Sanyang’s Bail Hearing

    High Court Judge Justice Ebrima Jaiteh has issued a firm order to the Edward Francis Small Teaching Hospital (EFSTH), demanding a comprehensive medical report on former soldier Abdoulie Sanyang to facilitate the determination of his bail application.

    Abdoulie Sanyang is charged with arson and interference with judicial proceedings. The charge stemmed from his interview with Peter Gomez program called Coffee Time

    When the case was called Counsel L. J. Darbo, J. Jeng & F. Bondi appeared for the applicant, and Counsel L. L. Jobarteh & S. Jawara for the State.

    The court had previously directed the hospital to conduct a medical examination and produce a report by October 20. However, a letter from an overseer in the Administration/Human Resources department informed the court that the report could not be completed as scheduled due to logistical difficulties.

    Justice Jaiteh expressed disappointment with the hospital’s lack of compliance, reminding them of their statutory obligation under Section 125 of the New Criminal Procedure Act, 2025. The section mandates government hospitals to provide medical certification in support of bail applications based on ill-health, especially when an offence punishable with life imprisonment may only be admitted to bail under “exceptional circumstances.”

    Justice Jaiteh emphasised that the hospital’s responsibility extends beyond merely acknowledging the court’s order; it requires full compliance by producing a detailed and certified medical report.

    To ensure prompt compliance, Justice Jaiteh ordered the Chief Medical Director of EFSTH to take the following actions:

    Specify a definite date within a reasonable period for the completion and submission of the medical report.

    Ensure the medical report explicitly indicates whether adequate medical facilities exist at the Mile II Central Prisons to effectively manage and treat Abdoulie Sanyang’s medical condition while he remains in detention.

    The matter has been adjourned to October 28, 2025, at 10:30 a.m. for the production of the medical report.

    The medical practitioner who conducts the examination and prepares the report is required to appear in person before the court on the adjourned date to formally present and speak to the contents of the report.

    “The Court expects strict and prompt compliance with the directives in the interest of justice and to facilitate the fair determination of the Applicant’s bail application,” the presiding judge stated.
