GAMBIA: CoPG Calls on Government to Immediately Clarify Allegations of Torture and Inhumane Treatment of Acquitted Ousainou Bojang

The Coalition of Progressive Gambians [CoPG] expresses deep concern over serious and persistent allegations that Ousainou Bojang, who was recently acquitted in the case concerning the murder of police officers, was subjected to torture and inhumane treatment while in state custody.

The right to dignity and protection from torture is absolute and non-derogable under Section 21 of the 1997 Constitution of The Gambia, the African Charter on Human and Peoples’ Rights, and the UN Convention Against Torture, to which The Gambia is a signatory. An acquittal by a competent court of law restores the presumption of innocence in full. Allegations that a citizen was abused in detention cannot be ignored or dismissed.

We therefore call on the Government of The Gambia to:

Issue an immediate and transparent public clarification addressing the specific allegations of torture and inhumane handling of Ousainou Bojang while he was in custody.
Institute an independent and credible inquiry into the conduct of all security personnel involved in his arrest and detention, with findings made public.
Ensure accountability by prosecuting any officer found to have violated the law and the constitutional rights of Mr. Bojang.
Reaffirm publicly the State’s commitment to the rule of law, due process, and the absolute prohibition of torture, regardless of the crime an individual is accused of.

Justice must not only be done, it must be seen to be done. These reasons call for the immediate and unconditional implementation of the TRRC recommendations, as listed in our nine point demands, to avoid future reoccurrences The credibility of our democracy and the integrity of our security services rest on respect for human rights and the rule of law. Failure to address these allegations risks eroding public trust in state institutions and the justice system.

CoPG stands with all Gambians in demanding a justice system that protects the innocent, holds the guilty to account, and upholds the dignity of every person. We urge civil society, the National Human Rights Commission, and international partners to monitor this matter closely.

For a credible and reliable democracy, there must be no room for torture.
