GAMBIA: Magistrate Principal Sallah Mbye Remanded Alleged Murderer in Manjai-Kunda.

Principal Magistrate Sallah Mbye has remanded an alleged murderer Momodou Samba Bah. The police prosecution brought Momodou Samba Bah to court for the murder of Mbaye Dem.

Sergeant Baldeh appeared for the Inspector General of Police and led the prosecution. According to the charge sheet, Momodou Samba Bah is charged with murder contrary to section 155 of the Criminal Offences Act 2025.

The prosecution alleged that on the 3rd March, 2026, at Manjie Kunda, with malice aforethought by an unlawful act caused the death of one Mbaye Dem by stabbing him with a knife in the neck causing his death.

Sergeant Baldeh informed the court that if found guilty, the accused (Momodou Samba Bah) could face a punishment of life imprisonment or death. He then applied for the case to be transferred and for the accused to be remanded for lack of jurisdiction.

In her ruling, Principal Magistrate Mbye said that after considering the prosecution’s application and examining the law, she agreed that the court did not have the jurisdiction to hear the case.

As a result, the magistrate ordered the transfer of the case to the special criminal court and also ordered the accused person to be remanded at the State Central Prison (Mile 2) pending the hearing at the High Court.
